Terms of Service

1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your use of the GigAlert application and website at gigalertapp.com (the “Service”) operated by GigAlert (“we,” “us,” or “GigAlert”). By creating an account, browsing as a guest, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age required in your country) and able to form a binding contract to use the Service. By using GigAlert you represent that you meet these requirements.

3. Your Account

You can create an account with an email and password or by signing in with Google. You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate information and to keep your profile information current. You may have one account. You cannot transfer your account to another person without our permission.

4. Guest Access

You may browse much of the Service as a guest without registering. Guests cannot submit reports or other content, post in chat, save stores, earn reputation, XP, or badges, or use account-specific features. GigAlert may limit, change, or end guest access at any time and may prompt guests to create an account to access certain features.

5. User-Submitted Reports and Content

GigAlert lets drivers submit community reports about store conditions, wait times, order issues, store status, inventory, road hazards, safety, restaurant issues, and delivery-app outages, along with optional notes, wait-time estimates, and—for the “Already Picked Up” issue—a customer’s first name and last initial. You are responsible for the accuracy of what you submit and for ensuring you have the right to post it.

You grant GigAlert a worldwide, royalty-free, non-exclusive license to host, display, use, and process the content you submit as needed to operate the Service, including showing it to other users and using it to calculate reputation and community trust signals. You understand that reports you submit are visible to the community and may include general location and store information.

6. Verification and the Trust System

Other drivers can confirm a report or mark it “not happening,” vote it inaccurate, or mark it helpful. These community responses feed GigAlert’s reputation system, which tracks the accuracy of your reports, your reputation score and level, your report weight, and your earned badges. Reports that the community consistently rejects may be down-ranked or removed, and affected reports may be appealed by contacting support.

Repeated inaccurate or false reporting can lower your reputation, place your account on accuracy probation, reduce or remove your report weight, or lead to suspension. You can appeal probation or suspension by emailing support with the details of your case.

7. Live Chat

Chat rooms are organized by geographic area so drivers nearby can communicate about local conditions. You are responsible for the messages you send. Do not post content that is unlawful, harassing, threatening, hateful, sexually explicit, or that invades another’s privacy. Other users may mute you, and GigAlert may restrict or remove chat access for violations. Chat messages may be retained for Service operation, history, abuse investigation, and enforcement of these Terms.

8. Notifications, Alerts, and Radius

GigAlert can send you push notifications for nearby alerts, platform outages, and account or game activity when enabled. Alerts are filtered using the radius and alert-type preferences you choose. Alert preferences are opt-out by default—every alert type is enabled unless you turn a type off, including alert types added later. You can manage notifications in your device settings or in the app.

9. Reputation, XP, Rewards, and Games

GigAlert awards experience points (XP), levels, streaks, badges, and garage items, and offers games such as Reaction Race, Driver Dash, and Bowling. These rewards have no monetary value and cannot be exchanged for cash. You may transfer XP to friends through features provided in the Service; you may not sell, trade outside the Service, or attempt to abuse the rewards system. GigAlert may adjust, reset, or revoke rewards, levels, scores, or game results in cases of suspected abuse, cheating, or violation of these Terms.

10. Saved Stores and Ratings

You can save stores you frequent and submit ratings about your experience with them. Ratings and saved stores are tied to your account and are visible or summarized for the community as part of the Service. You agree to rate stores truthfully and based on your own experience.

11. Prohibited Conduct

You agree not to:

  • Submit false, misleading, or knowingly inaccurate reports, or submit reports for stores you are not actually at.
  • Impersonate another person or misrepresent your identity or affiliation.
  • Harass, threaten, or defame other users, or post hate, discriminatory, or sexually explicit content.
  • Reveal another person’s private information without consent, except the limited customer first name and last initial used to match an “Already Picked Up” order.
  • Spam chat, manipulate votes or reputation, or coordinate to inflate or suppress reports or ratings.
  • Attempt to access accounts, data, or systems you are not authorized to access, or interfere with the Service’s operation.
  • Scrape, copy, or redistribute Service content or data without permission.
  • Use the Service for any illegal purpose or in a way that violates these Terms.

12. Account Suspension and Termination

You may delete your account at any time through Profile → Delete Account or by emailing support. We may suspend, restrict, or terminate your account, revoke rewards, remove content, or block access if you violate these Terms, behave abusively, submit false reports, misuse the rewards or chat systems, or create a risk to GigAlert, other users, or third parties. An admin may deactivate an account for serious or repeated violations. Where possible, we will act consistently and may provide notice, though we are not required to do so where awaiting notice would create a safety or security risk.

13. Account and Data Deletion

You can delete your account and request deletion of your personal data at any time via Profile → Delete Account (which removes your GarageProfile, friends, game invites, and reputation data), or by emailing matthewjbrynes@gmail.com. Some data may be retained where required by law or for legitimate safety and fraud-prevention reasons.

14. Third-Party Services and Links

The Service uses third-party sign-in (such as Google), mapping and place data (such as Google and OpenStreetMap), email delivery, and platform push services (Apple and Google Play), and may link to third-party sites. GigAlert is not responsible for the practices or content of third parties. Your use of third-party services is subject to their terms and policies.

15. Disclaimers

The Service, including all reports, wait-time estimates, store ratings, status indicators, and chat messages, is provided “as is” and “as available.” GigAlert does not guarantee the accuracy, timeliness, or reliability of community-submitted information. Reports reflect other drivers’ observations and may be wrong, outdated, or expired. Store closures, wait times, and outage statuses are community estimates, not official statements from any business or delivery platform. You use the Service at your own risk and should verify important information independently. GigAlert disclaims all warranties to the extent permitted by law.

16. Limitation of Liability

To the maximum extent permitted by law, GigAlert and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of or inability to use the Service, or from reliance on community-submitted content. Our aggregate liability for any claim is limited to the greater of any amount you paid us for the Service (if any) or one hundred U.S. dollars ($100).

17. Indemnification

You agree to indemnify and hold GigAlert harmless from any claims, damages, or expenses arising from your content or conduct, your violation of these Terms, or your violation of any law or third-party right.

18. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles, and any disputes will be resolved in the United States. If a specific provision is unenforceable, the rest remain in effect.

19. Changes to These Terms

We may update these Terms from time to time. We will revise the “Last updated” date above when we do. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
